Two layers. §140 Billigung is catalog approval with a public-peace gate. §130 Volksverhetzung is the classification overlay. Do not collapse them.

Test: Publicly approving a catalog offence in a manner capable of disturbing the public peace. Approving means standing morally behind the offender as to a concrete catalog act — not a free-floating praise crime.
Who decides: Staatsanwaltschaft / courts. Volksverhetzung §130 is the classification overlay, not the praise statute.

§ 140 Nr. 2 — Billigung von Straftaten

Target: Public approval of a catalog offence (including murder, genocide, war crimes, and other §126/§138 listed acts), including foreign catalog acts capable of disturbing the domestic public peace
Test: Publicly, in an assembly, or by disseminating content, approve the act in a manner capable of disturbing the public peace. Approval means standing morally behind the offender as to a concrete catalog act. A free-floating hurrah is not enough.
Max: Up to 3 years or a fine

Wer eine der in § 138 Absatz 1 Nummer 2 bis 4 und 5 letzte Alternative oder in § 126 Absatz 1 genannten rechtswidrigen Taten oder eine rechtswidrige Tat nach § 176 Absatz 1 oder nach den §§ 176c und 176d 1. belohnt, nachdem sie begangen oder in strafbarer Weise versucht worden ist, oder 2. in einer Weise, die geeignet ist, den öffentlichen Frieden zu stören, öffentlich, in einer Versammlung oder durch Verbreiten eines Inhalts (§ 11 Absatz 3) billigt, wird mit Freiheitsstrafe bis zu drei Jahren oder mit Geldstrafe bestraft.

Germany’s listed-speech-adjacent offence is catalog + public peace, not a protected-class sticker.

Since 2021 the approval limb is no longer limited to already-committed acts in the same way as rewarding. Still a catalog, still a public-peace gate.
Do not describe §140 as Volksverhetzung. That is §130.

Target: Incitement to hatred against a national, racial, religious, or ethnic group, or a part of the population; also Holocaust denial under §130(3)
Test: Capable of disturbing the public peace. Incitement to hatred, or attack on human dignity by insult, malicious contempt, or defamation of the group.
Max: §130(1): 3 months to 5 years. §130(3): up to 5 years or a fine

Wer in einer Weise, die geeignet ist, den öffentlichen Frieden zu stören, 1. gegen eine nationale, rassische, religiöse oder durch ihre ethnische Herkunft bestimmte Gruppe, gegen Teile der Bevölkerung oder gegen einen Einzelnen wegen dessen Zugehörigkeit zu einer vorbezeichneten Gruppe oder zu einem Teil der Bevölkerung zum Hass aufstachelt, zu Gewalt- oder Willkürmaßnahmen auffordert oder 2. die Menschenwürde anderer dadurch angreift, dass er eine vorbezeichnete Gruppe, Teile der Bevölkerung oder einen Einzelnen wegen dessen Zugehörigkeit zu einer vorbezeichneten Gruppe oder zu einem Teil der Bevölkerung beschimpft, böswillig verächtlich macht oder verleumdet, wird mit Freiheitsstrafe von drei Monaten bis zu fünf Jahren bestraft.
