§ 282a

- Public invitation to a terrorist offence, or public approval of a terrorist offence capable of creating a risk of further such offences

- In a print work, radio, television, or another medium, or otherwise publicly in a way accessible to many people. Abs. 1 is invitation (Aufforderung). Abs. 2 is approval (Gutheissung) gated on suitability to bring about the danger of one or more terrorist offences. No requirement that a further offence follow.

Wer in einem Druckwerk, im Radio, Fernsehen oder einem anderen Medium oder sonst öffentlich auf eine Weise, dass es vielen Menschen zugänglich wird, zur Begehung einer terroristischen Straftat (§ 278c Abs. 1 Ziff. 1 bis 9 oder 10) auffordert, ist, wenn er nicht als an dieser Handlung Beteiligter (§ 12) mit strengerer Strafe bedroht ist, mit Freiheitsstrafe bis zu zwei Jahren zu bestrafen. Ebenso ist zu bestrafen, wer auf die im Abs. 1 bezeichnete Weise eine terroristische Straftat (§ 278c Abs. 1 Ziff. 1 bis 9 oder 10) in einer Art gutheisst, die geeignet ist, die Gefahr der Begehung einer oder mehrerer solcher Straftaten herbeizuführen.

- Do not treat §282a as Israel §24. Do not drop the Gefahr gate on Abs. 2. Do not quote §283 as the terror-approval cell.
- Gutheissung in Abs. 2 is approval of a terrorist offence. It is gated on Gefahr — a risk that further such offences will be committed. That is closer to encouragement-with-risk than to free-floating apologie of a past act. Listed-speech offence, not praise of designated terrorist acts.
- §283 Diskriminierung (public incitement to hatred or discrimination on listed grounds) is a neighbouring overlay cell, not this quote.
- §278c Abs. 1 Ziff. 9a lists §282a in the terrorist-offence catalogue. Catalogue listing still requires the Abs. 1 quality gate. Do not collapse the speech cell into membership (§278b).
